Terms of Service

1. Acceptance of Terms

By creating an account, accessing, or using Omoyo, you represent and warrant that:

• You are at least 13 years of age (or the minimum age required in your jurisdiction to consent to the processing of personal data, whichever is higher);
• You have the legal capacity and authority to enter into this Agreement;
• You will comply with all applicable local, state, national, and international laws and regulations;
• All information you provide is accurate, current, and complete, and you will maintain and update it as necessary;

If you are using Omoyo on behalf of an organization, you represent that you have authority to bind that organization to these Terms, and "you" will include both you and that organization.

2. Description of Services

Omoyo provides a cross-platform Go (Baduk/Weiqi) ecosystem including but not limited to:

• Real-time multiplayer Go matchmaking and private play;
• AI-powered game analysis using KataGo and our edge infrastructure (AI Worker);
• Interactive AI personalities with distinct playing styles and dialogue;
• Cloud-based game record (SGF) storage and synchronization;
• Educational puzzles, courses, and rank tracking;
• Web and mobile applications (iOS, Android) for accessing the Services.

We reserve the right to modify, suspend, or discontinue any aspect of the Services at any time, with or without notice. We aim for high availability but do not guarantee that the Services will always be available, uninterrupted, or error-free.

3. User Accounts and Registration

To access certain features, you must create an account. You agree to:

• Provide accurate, current, and complete information and maintain it;
• Maintain the security of your account credentials (passwords, authentication tokens);
• Accept responsibility for all activities under your account;
• Notify us immediately of any unauthorized use or breach of security;
• Not transfer your account or share credentials with third parties.

You are solely responsible for maintaining the confidentiality of your credentials. We are not liable for any loss or damage arising from your failure to comply. Guest accounts: Data may be stored locally; we are not responsible for data loss due to app uninstallation or device failure.

4. Acceptable Use Policy

You agree to use Omoyo only for lawful purposes and in accordance with these Terms and all applicable laws. You agree NOT to use the Services to:

4.1 Prohibited Content and Conduct

• Upload, store, or transmit content that is illegal, harmful, threatening, abusive, harassing, defamatory, invasive of privacy, or otherwise objectionable;
• Distribute content that infringes intellectual property, privacy, or other rights of any third party;
• Use the Services for hate speech, discrimination, or to promote violence;
• Transmit malware, viruses, or other malicious code;
• Impersonate any person or entity or misrepresent your affiliation;
• Interfere with, disrupt, or damage the Services, servers, or networks;
• Attempt to gain unauthorized access to any part of the Services or other accounts;
• Use automated systems (bots, scrapers, crawlers) to access or harvest data without our express written permission;
• Reverse engineer, decompile, or attempt to derive source code of the Services;
• Remove or alter any proprietary notices or marks on the Services.

4.2 Anti-Cheating and Fair Play

No Unauthorized AI Assistance: You are strictly prohibited from using external AI software, bots, or any form of computerized assistance during ranked matches against human players, unless specifically allowed in designated "AI-allowed" rooms or modes.

Detection and Enforcement: We use behavior analysis and technical measures to detect cheating. If we determine, in our sole discretion, that you have cheated, we may reset your rank, mark affected games as losses, or permanently ban your account without refund. We reserve the right to take any action we deem appropriate to protect fair play.

4.3 Content Moderation and Reporting

We reserve the right to review, remove, or disable access to any content that we determine violates these Terms or is otherwise objectionable. We may suspend or terminate accounts and report illegal content to authorities. If you become aware of any violation, please report it to [email protected].

5. Service Usage Restrictions and Fair Use

To ensure fair access and optimal performance for all users, we enforce the following usage and fair use policies.

5.1 Personal and Non-Commercial Use

Omoyo's Services are intended for personal, non-commercial use. Commercial use (e.g. reselling analysis credits, using the Services as a core business infrastructure for commercial delivery to large numbers of clients, or sublicensing access) is prohibited unless you have obtained explicit written authorization from Omoyo. We may suspend or terminate accounts that we determine are used for unauthorized commercial purposes.

5.2 No Unauthorized Automation or API Abuse

You must access Omoyo through our official clients (web, iOS, Android) and genuine human interaction. You agree NOT to: reverse engineer or attempt to discover our API endpoints or internal protocols; use bots, scripts, or automation to interact with the Services; create third-party tools that interact with Omoyo without authorization; circumvent authentication, rate limits, or security features; or send requests at a frequency or volume that exceeds reasonable human use (e.g. excessive AI analysis requests that impact service availability). We may block, throttle, or terminate access for automated or abusive usage.

5.3 Fair Use of AI Analysis and Resources

AI analysis and related features are provided on a shared infrastructure. Usage that significantly exceeds typical patterns (e.g. sustained high-volume analysis requests, or use that degrades service for others) may be subject to rate limiting, throttling, or suspension. We will make reasonable efforts to communicate before imposing restrictions, except where immediate action is needed to protect the service or other users.

6. User Content and Intellectual Property

6.1 Your Ownership and License to Us

You retain ownership of the game records (SGF files), annotations, and other content you create through Omoyo ("User Content"). To enable us to provide the Services, you grant Omoyo a limited, non-exclusive, royalty-free license to use, store, process, display, and reproduce your User Content solely to: store and sync your content; display it to you and to users you authorize (e.g. opponents, shared links); generate analysis and technical derivatives; back up and restore; and comply with law or protect security. This license remains in effect while your account is active and for a reasonable period thereafter for backup and legal compliance. We do not use your User Content for marketing or unrelated commercial purposes.

You represent and warrant that you own or have the necessary rights to your User Content, that it does not infringe third-party rights, and that it complies with applicable laws. You are responsible for your User Content and the consequences of sharing it.

6.2 Omoyo Intellectual Property

The Services, including the Omoyo name, logos, UI, board design, stone animations, AI personality logic, and software, are owned by Omoyo or its licensors and are protected by intellectual property laws. You receive a limited, non-exclusive, non-transferable license to use the app for personal, non-commercial purposes in accordance with these Terms. You may not copy, modify, distribute, or create derivative works of our proprietary materials without our prior written consent.

7. Subscription, Payment, and Refunds

Certain features require an active subscription or the purchase of analysis credits. By subscribing, you agree to pay all fees described at the time of purchase. Subscription fees are billed in advance on a recurring basis (e.g. monthly, annually). You authorize us to charge your chosen payment method for each billing cycle until you cancel.

7.1 Platform Payment Systems

In-app purchases and subscriptions are processed through Apple (App Store) or Google (Google Play). You agree to comply with the applicable platform's terms and conditions. We do not collect or store your full payment card details; payment processing is handled by Apple, Google, and our subscription partner (e.g. RevenueCat).

7.2 Auto-Renewal and Cancellation

Subscriptions automatically renew unless you cancel at least 24 hours before the end of the current billing period. You can manage or cancel subscriptions through your device's account settings (Apple ID or Google Play). Cancellation prevents future charges but does not refund the current period; you retain access until the end of that period. Deleting the app does not cancel your subscription.

7.3 Pricing and Refunds

Prices may vary by region and platform. We may change pricing with reasonable notice (e.g. 30 days for existing subscribers). Refunds are handled by Apple or Google in accordance with their policies. To the maximum extent permitted by law, we do not guarantee refunds; any refund requests for in-app purchases must be directed to the applicable platform. In the EU, you may have statutory withdrawal rights (e.g. 14 days) where applicable; if you request that we begin performance immediately (e.g. by using premium features), your right of withdrawal may be waived once performance has begun, in accordance with applicable law.

8. Third-Party Services and SDKs

Omoyo integrates third-party SDKs and services (e.g. Supabase, RevenueCat, Firebase, Cloudflare) for authentication, payments, analytics, and infrastructure. Your use of these features is subject to the respective providers' terms and privacy policies. We are not responsible for the actions, omissions, or practices of these third parties. We may update, add, or remove third-party services from time to time and will notify you of material changes when reasonably possible.

9. Disclaimers and Limitation of Liability

9.1 AI and Analysis Disclaimer

Omoyo uses neural networks (e.g. KataGo) for game analysis. You acknowledge that: AI analysis is probabilistic and not a guarantee of absolute strategic truth; AI personalities are simulated and their dialogue and behavior are for entertainment and education; we are not liable for any loss of rank, frustration, or other consequences resulting from reliance on AI analysis or AI interaction.

9.2 General Disclaimers

The Services are provided "as is" and "as available." We disclaim all warranties, express or implied, to the extent permitted by law. We do not guarantee uninterrupted, error-free, or secure operation.

9.3 Limitation of Liability

10. Termination

By You: You may terminate this Agreement at any time by deleting your account and ceasing use of the Services.

By Us: We may suspend or terminate your access immediately if you breach these Terms, engage in illegal activity, abuse the Services, or if we cease offering the Services in your region. Upon termination, your license to use our proprietary content ends. We may retain and use your data as described in our Privacy Policy (e.g. backup, legal compliance, archival game records).

11. Modifications to the Terms

We reserve the right to amend these Terms at any time. We will notify you of material changes via in-app notification or email. Your continued use of the Services after the effective date of changes constitutes acceptance of the revised Terms. If you do not agree, you must stop using the Services and may delete your account.

12. Governing Law and Dispute Resolution

This Agreement is governed by the laws of England and Wales, without regard to conflict of law principles. Any dispute arising from these Terms shall first be addressed through good-faith informal negotiation. If unresolved after a reasonable period (e.g. 60 days), the dispute shall be submitted to the exclusive jurisdiction of the courts located in London, United Kingdom. Nothing in these Terms prevents you from invoking mandatory consumer protection rights in your country of residence.
